Georgia’s Drunk Driving Laws

Under O.C.G.A. §40-6-391(a)(1), a person can be charged with the criminal offense of driving under the influence of alcohol if their consumption made it “less safe” for them to operate a motor vehicle.

Impairment is assumed when the driver’s blood alcohol content (BAC) level is at certain points:

  • 0.02% – Drivers under the age of 21
  • 0.04% – Commercial motor drivers
  • 0.08% – All other drivers

What Are the Penalties for a DUI in Georgia?

Georgia’s impaired driving laws impose strict penalties, including:

  • First offense – Criminal penalties include up to one year in jail, a fine of between $300 and $1,000, 40 hours of community service, and a license suspension of up to one year.
  • Second offense within five years of the first offense – Criminal penalties include up to one year in jail and a mandatory minimum of two days in jail, a fine of between $600 and $1,000, a minimum of 30 days of community service, a mandatory clinical evaluation, and a license suspension of up to three years.
  • Third offense within five years of the second offense – Criminal penalties include up to one year in jail and a mandatory minimum of 15 days in jail, a fine of between $1,000 and $5,000, a minimum of 30 days of community service, a mandatory clinical evaluation, and a license suspension of up to five years.

Additionally, the court can order a driver to have an ignition interlock device installed in their vehicle for second and subsequent offenses. License plates are also seized if a driver is convicted of a second or subsequent DUI within five years. 

Underage drivers who are convicted of impaired driving must delay obtaining their graduated license for one year.

According to the Georgia Governor’s Office of Highway Safety, 353 people died in crashes that involved a driver with a BAC of 0.08% or higher in 2019. The Centers for Disease Control and Prevention (CDC) reports that, nationwide, 29 people die every day in drunk driving crashes.
